If the overstay is less than 3 months, a contravention report will be drawn up in accordance with Article 333, paragraph (1) of the Contravention Code of the Republic of Moldova, and a return decision will be issued.
However, if the overstay exceeds 3 months, the provisions of Articles 9 and 10 of Law no. 200/2010 on the regime of foreigners in the Republic of Moldova will apply.
In the event of early termination of the individual employment contract, the beneficiary applicant shall notify the competent immigration authority within 5 working days in order to revoke the right of residence.
If you have entered the territory of the Republic of Moldova without passing through a border crossing point, you must immediately report this situation to the nearest border crossing point or one of the territorial subdivisions of the General Inspectorate of the Border Police (GIBP).
If you are in Chișinău, you can go directly to the GIBP headquarters at 19 Petricani Street, where you will receive the necessary guidance. This procedure is mandatory and contributes to resolving your situation legally.
If your residence permit expired, the fine you have to pay is between 600 lei and 1500 lei because the sanction is from 12 to 30 conventional units, and one unit is 50 lei. This is provided for by Article 333, paragraph 1 of the Contravention Code.
If a foreign citizen or stateless person violates the rules of stay in the Republic of Moldova by remaining in the country after the permitted period of stay or residence has expired, a fine of 12 to 30 conventional units may be imposed.
However, individuals who voluntarily leave the Republic of Moldova within 15 days after their authorized stay expires are not subject to a fine.

The calculation should be done in such a way that the whole period does not exceed 90 days during each 180-day period.
Only for citizens of the Republic of Azerbaijan the period of stay on the territory of the Republic of Moldova is calculated from the date of the last entry. Other foreign citizens are subject to the general rule: 90 days within a 180-day period.

The General Inspectorate for Migration (IGM) strictly respects the principle of non-refoulement, enshrined in Article 4 of Law No. 270/2008 on Asylum in the Republic of Moldova, as well as in international instruments to which Moldova is a party, including Article 3 of the European Convention on Human Rights and the UN Convention against Torture.
Moreover, according to Article 63(3) of Law No. 200/2010 on the Regime of Foreigners, a foreigner cannot be removed from the territory of the Republic of Moldova if "there are well-founded reasons to believe that his/her life is in danger or that he/she risks being subjected to torture, inhuman or degrading treatment in the country to which he/she would be returned."
In this context, during procedures of return, readmission, or removal under escort, the IGM applies individualized protection measures to ensure that no person is returned to a country where there are real risks of violations of fundamental rights.
To ensure compliance with the principle of non-refoulement, the following actions are undertaken:
● analysis of the situation in the destination country and the personal circumstances of the foreigner;
● verification of the existence of an asylum procedure, protection status, or tolerated status;
● consultation with competent authorities and, if necessary, international organizations (e.g. UNHCR, IOM).
The General Inspectorate for Migration acts strictly within the legal framework and in full compliance with the international obligations undertaken by the Republic of Moldova, guaranteeing that no foreigner is removed, expelled, or forcibly returned in conditions that would violate the principle of non-refoulement.
A foreigner may stay in the Republic of Moldova for a maximum of 90 days within any 180-day period.
If all 90 days (consecutively or cumulatively) have been used, the person cannot re-enter the country until those days are no longer counted within the 180-day window.
In practice, if a foreigner stayed 90 days without interruption, they can return only after another 90 days of absence.

Violation of stay regulations by foreign citizens or stateless persons in the Republic of Moldova, by failing to leave the territory of the country upon the expiration of the granted period of stay, is sanctioned with a fine ranging from 12 to 30 conventional units. The fine may be paid online.
This sanction does not apply to foreign citizens who voluntarily leave the territory of the Republic of Moldova within 15 days after the expiration of the granted period of stay, or to holders of travel documents domiciled in localities on the left bank of the Dniester (transnistrian region).
