Before a decision on the asylum application is taken, the asylum seeker is given the opportunity to be interviewed on his/her application.
The interview shall be conducted as soon as possible, but no later than 21 days after the date of lodging the application. If further investigation of information from the country of origin and other relevant circumstances relating to the asylum application is necessary, the deadline may be extended by 21 days.
The interview takes place in conditions of confidentiality.
The interview is conducted by an eligibility adviser who is obliged to ensure the organization and smooth conduct of the interview.
The interview will be conducted in the language of the applicant's choice. Where it is reasonably presumed that the applicant knows another language, the interview may be conducted in that language.
During the interview, the rights and obligations of asylum seekers will be explained.
In the case of unaccompanied minor asylum seekers, the interview will be conducted in the presence of their legal representative.
In the case of persons lacking discernment, the interview shall be conducted in the presence of their guardian or curator.
In the case of victims of torture or other inhuman or degrading treatment, the interview may be attended by a psychologist or a specialized doctor.
The asylum-seeker may be interviewed in the presence of a lawyer or UNHCR representative.
An interview is needed in order to establish the conditions for granting a form of protection provided by applicable law of the Republic of Moldova. During the interview the asylum seeker is obliged to tell the truth and provide all the elements, evidence in connection with his statements on the reasons for his fears.
There is no standard length of time for an interview. It
varies from case to case (on average 3 hours). If a break is needed during the interview, the asylum seeker can request it at any time.
