IGM Responds: Top 5 frequently asked questions

The General Inspectorate for Migration (IGM) provides responses to the top 5 frequently asked questions submitted by foreigners to the IGM Green Line in recent periods. Responses will be provided on a regular basis to clarify matters of interest to IGM beneficiaries.

1. Under what conditions can an LLC administrator obtain the right of residence?
The conditions for obtaining the right of residence for employment purposes as an LLC administrator may be consulted in Article 43/6 of Law No. 200/2010 regarding the regime of foreigners in the Republic of Moldova.

2. I reside in Moldova with a residence permit for family reunification. How can I obtain official employment?
Foreigners who are holders of the right of residence and a temporary residence permit obtained for the purpose of family reunification may be employed without prior issuance of a residence permit for employment purposes or a temporary residence permit for employment purposes.

3. If I have exceeded the permitted period of stay in the territory of the Republic of Moldova, what consequences will I face upon leaving the country? Will I be fined, in what amount, and can I pay online?
Violation of stay regulations by foreign citizens or stateless persons in the Republic of Moldova, by failing to leave the territory of the country upon the expiration of the granted period of stay, is sanctioned with a fine ranging from 12 to 30 conventional units. The fine may be paid online.

This sanction does not apply to foreign citizens who voluntarily leave the territory of the Republic of Moldova within 15 days after the expiration of the granted period of stay, or to holders of travel documents domiciled in localities on the left bank of the Dniester (transnistrian region).

4. After illegally crossing the border, I submitted a statement to the Border Police and requested temporary protection, but I wish to travel to Poland where my entire family resides. When may I leave Moldova?
Temporary protection in the Republic of Moldova constitutes a legal guarantee of residence and access to essential rights for a limited period. In this context, a foreigner who opts for temporary protection is entitled to a 30-day period from the scheduled date of effective documentation. If the documentation is not completed within this period, the registration expires and becomes null and void.

Authorization to cross the state border, including exit from the territory of the Republic of Moldova, falls under the competence of the Border Police. In the case of a foreigner who has crossed the border illegally, it is essential to verify whether the administrative procedure concerning this act has been completed and whether any legal measures restricting the right to free movement have been imposed.

5. When applying for the right of residence, may I submit my criminal record online?
The application for the issuance of a temporary residence permit must be accompanied by a criminal record certificate or another document of equivalent legal value, translated and legalized/apostilled by the authorities of the foreigner’s country of citizenship. In the event that the foreigner has legally resided for at least two years in a country other than their country of citizenship, they must present a criminal record certificate or equivalent document issued by the authorities of the country of residence, translated and legalized/apostilled, as well as the document confirming the right of residence.
