The General Inspectorate for Migration (GIM) informs employers in the agricultural sector that, in the context of intensified seasonal activities typical for this period, the employment of foreign citizens for agricultural work is regulated under a simplified documentation procedure.
According to Article 4314 of Law No. 200/2010 on the Regime of Foreigners in the Republic of Moldova, foreign citizens who come for seasonal work purposes may be employed through a facilitated process.
Key conditions for employment:
- Seasonal work may be carried out for a period of up to 9 months, calculated cumulatively within a 12-month calendar period;
- The seasonal worker must be employed under an individual employment contract with the employer, and must hold a confirmation of the right to temporary stay in the Republic of Moldova, issued by the General Inspectorate for Migration;
- The procedure for obtaining the right to stay is simplified for this type of activity and requires a minimal set of supporting documents. See here.
Employers are required to notify GIM about the employment of foreign citizens within 5 working days from the start date of the employment and must comply with all legal conditions regarding wages, working conditions, and accommodation (where applicable).
Recommendations for employers:
- Verify the eligibility of the foreign candidate and the validity of their travel documents.
- Submit the Declaration requesting the right to temporary stay in the Republic of Moldova for seasonal agricultural workers to the territorial subdivisions of GIM.
- Avoid illegal employment, which may result in administrative sanctions and restrictions on future employment of foreign nationals.
The General Inspectorate for Migration reaffirms its readiness to support agricultural businesses in the process of documenting foreign labor, offering consultations and assistance through its territorial subdivisions.
