In order to return to the usual legal framework regulating the regime of foreigners in the Republic of Moldova, following the provision of the Commission for Exceptional Situations of 10 May 2023, the General Inspectorate for Migration of the MIA recalls that it has undertaken a series of actions aimed at facilitating the integration of all foreigners into Moldovan society. At the same time, a legal framework has been created to provide access to essential services to persons displaced from Ukraine to our country because of the war.
Special attention is paid to the granting of temporary protection to displaced persons from Ukraine, a form of protection that comes with several facilities and rights offered by the State of the Republic of Moldova. At the moment 1912 pre-registered applications have been received in the information system of the General Inspectorate for Migration on temporary protection, a total of 3640 persons. 1894 identity documents have been issued to beneficiaries of protection, of which 634 for minors.
Since 15 May, the deadline for the stay of foreigners displaced from Ukraine on the territory of the Republic of Moldova has been restored to 90 calendar days within the period of 180 calendar days preceding each day of stay, as provided for in Article 84 para. (3) of Law 200/2010 on the Regime of Foreigners in the Republic of Moldova. The duration of stay will be calculated from 15 May 2023. Thus, the period of stay on the territory of the Republic of Moldova until 15 May 2023 will not be taken into account for this category of persons.
It should be noted that a number of derogations for citizens of Ukrainian origin have previously been provided for from the Law No. 200/2010 on the Regime of Aliens in the Republic of Moldova and from the Law No. 270/2008 on Asylum in the Republic of Moldova, including:- it was accepted for Ukrainian citizens to stay in the Republic of Moldova for more than 90 days during the period of 180 calendar days, during the state of emergency, without holding a right of residence;- simplified the procedure for obtaining the right of residence without presenting the judicial certificate from the country of origin;- the state fees for the examination of applications for the right of residence have been waived;- the obligation for the applicant beneficiary to provide the immigrant worker from Ukraine with an average monthly salary on the economy forecast for the year of administration has been excluded;- the visa requirement for family members of Ukrainian citizens and stateless persons recognised by the Ukrainian authorities applying for the right of residence on the territory of the country has been excluded;- the requirement for Ukrainian students and stateless persons recognised by the Ukrainian authorities to present a document confirming means of subsistence has been abolished.
These facilities remain valid until 15 May 2023.
The competent authority for foreigners of the Ministry of Interior emphasizes the importance of legal stay and residence on the territory of the Republic of Moldova of foreigners and displaced persons from Ukraine and in this regard encourages the application for temporary protection or obtaining a right of residence for a specific purpose.
