Any foreign national or stateless person who wishes to apply for a form of protection may submit an application for asylum.
The asylum application may be submitted to the Asylum and Statelessness Department of the General Inspectorate for Migration, to the Border Police, to the police bodies, to the National Penitentiary Administration of the Ministry of Justice or the pre-trial detention subdivisions of the law enforcement agencies.
The applications for political asylum must be submitted to the Administration of the President of the Republic of Moldova and must be addressed directly to the President of the Republic of Moldova.
In order to establish the conditions for granting a form of protection provided for by the legislation in force of the Republic of Moldova, before a decision on the asylum application is taken, the asylum seeker shall be given the opportunity to be interviewed on his/her application. He/she is obliged to tell the truth and to provide all the elements, evidence in relation to his/her statements concerning the reasons for his/her fear.
The decision on asylum application represents the reasoning of fact and law regarding the applicant's request for asylum.
The decision is taken by the General Inspectorate for Migration (in the case of requests for political asylum, the decision is made by the the Commission on the issues of nationality and granting of political asylum under the President of the Republic of Moldova) and it is communicated to the applicant personally by the eligibility advisor.
