Rights and duties of applicants for stateless status

Rights

While the application is being examined, the applicant has the right to stay in the Republic of Moldova and may be removed from its territory only if there are national security or public order reasons.


The General Inspectorate for Migration shall issue the applicant with a certificate confirming his/her status throughout the examination of the application (confirmation certificate).


In spoken or written communication, the applicant may use his/her mother tongue or another language he/she possesses.

Duties

  • to cooperate fully with the General Inspectorate for Migration

  • to submit evidence or any other information relevant for the recognition of his/her statelessness status


  • to present himself/herself for interview at the General Inspectorate for Migration whenever necessary


  • to respect the legislation of the Republic of Moldova..

Rights and duties of stateless persons

  • Right of domicile in the Republic of Moldova
  • The right to work and its protection in accordance with the legislation in force;
  • The right to rest and health protection on a general basis just as the citizens of the Republic of Moldova;
  • The same rights and obligations in the field of compulsory health care insurance just as the citizens of the Republic of Moldova, in accordance with the legislation in force, unless international treaties provide otherwise;
  • The right to receive allowances, pensions and other social security benefits in accordance with the legislation in force;
  • Stateless persons residing in the Republic of Moldova are guaranteed freedom of conscience, opinion and expression in accordance with the legislation in force;
  • The right to marry and to dissolve marriages with citizens of the Republic of Moldova, with other persons, in accordance with the legislation in force. Stateless persons enjoy the same rights and have duties in family relations just as the citizens of the Republic of Moldova;
  • The right to move within the territory of the Republic of Moldova and to take up residence in the manner established by the legislation in force;
  • The right to housing just as the citizens of the Republic of Moldova;
  • The right to dispose of one's home and other private property, to inherit or testament property, to benefit from the copyright of a literary, artistic or scientific work, a discovery, an invention, and other personal non-patrimonial rights;
  • The same educational rights as citizens of the Republic of Moldova. Stateless persons admitted to study in educational institutions have rights and duties, in accordance with the legislation in force and the rules established by these institutions;
  • The right to join on a general basis as citizens of the Republic of Moldova various cultural, scientific, sports, cooperative organizations, production associations, unless their statutes provide otherwise;
  • Stateless persons residing in the Republic of Moldova are guaranteed freedom of conscience, opinion and expression in accordance with the legislation in force;
  • The right to marry and dissolve marriages with citizens of the Republic of Moldova, with other persons, in accordance with the legislation in force. They enjoy the right and have the duties in family relations just as the citizens of the Republic of Moldova;
  • The right to move within the territory of the Republic of Moldova and to take up residence in the manner provided for by the legislation in force;
  • Stateless persons shall be guaranteed inviolability of person and residence in accordance with the legislation in force. They have the right to effective satisfaction by competent courts of law, other public authorities against acts violating their rights, freedoms and legitimate interests;
  • Stateless persons, in accordance with the legislation on parliamentary lawyers, have the right to address petitions to the parliamentary lawyer in cases of violation in the Republic of Moldova of their legitimate rights and interests;
  • Stateless persons shall enjoy the same procedural rights in court proceedings as the citizens of the Republic of Moldova;
  • Stateless persons shall be subject to taxes, duties and other payments on a general basis as the citizens of the Republic of Moldova unless international agreements to which the Republic of Moldova is a party provide otherwise.
